These Terms of Service ("Terms") govern access to and use of the LayerLux Studio website, customer account system, custom-order portal, products, and related services.
The website and services are operated by LayerLux Studio LLC, a Virginia limited liability company ("LayerLux Studio," "we," "us," or "our").
By accessing the website, creating an account, submitting a custom request, approving a design, accepting a quote, or purchasing a product, you agree to these Terms and any policies incorporated into them.
If you do not agree, please do not use the website or submit an order.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, submit a custom request, or place an order.
If you place an order on behalf of a company or organization, you represent that you have authority to bind that company or organization to these Terms.
2. Customer accounts
You agree to provide current, complete, and accurate information when creating an account or submitting an order.
You are responsible for:
- Protecting your login credentials;
- Activities performed through your account;
- Maintaining an accurate email address, telephone number, billing address, and shipping address; and
- Notifying us promptly if you believe your account has been accessed without authorization.
We may suspend or terminate an account that contains inaccurate information, is being used improperly, or creates a security, legal, or operational risk.
3. Custom requests and order acceptance
Submitting a custom request, adding a product to a request form, or requesting a quote does not require LayerLux Studio to accept or produce the requested product.
A request becomes an accepted order only after:
- LayerLux Studio confirms that it can fulfill the request;
- The customer approves the applicable design and specifications;
- LayerLux Studio issues a final quote or invoice; and
- Payment is received, unless different payment terms are approved by LayerLux Studio in writing.
We reserve the right to accept or decline any request, including requests that may be unsafe, technically impractical, unlawful, offensive, or potentially infringing.
Our Custom Order Policy is incorporated into these Terms.
4. Quotes, prices, and taxes
Prices displayed on the website or included in preliminary communications may be estimates.
Final pricing may depend on:
- Product dimensions;
- Materials and colors;
- Printing and finishing time;
- Design or modeling work;
- Hardware, lighting, or other components;
- Quantity;
- Packaging;
- Shipping destination; and
- Applicable taxes.
The final price will be stated in the quote or invoice. Quotes are valid for the period stated in the quote. If no expiration date is provided, the quote is valid for 14 calendar days.
Prices and product availability may change before an order is accepted. Price changes will not affect an order that has already been accepted and paid for unless the customer requests a modification.
Customers are responsible for applicable sales, use, customs, import, value-added, or similar taxes and fees, except for taxes imposed directly on LayerLux Studio's income.
5. Payments
LayerLux Studio does not directly collect or store complete payment-card information through its custom-order portal.
Approved orders may be invoiced through QuickBooks or another disclosed payment provider. Payment must be completed using the secure payment link included with the invoice.
Your payment is also subject to the payment provider's terms and privacy practices.
Unless we agree otherwise in writing:
- Full payment is required before production begins;
- An unpaid invoice does not reserve production time, materials, or inventory;
- LayerLux Studio may cancel an unpaid invoice after its stated due date; and
- The customer is responsible for fees resulting from a reversed or disputed payment when the charge was validly authorized.
If you believe an invoice contains an error, contact us before submitting payment.
6. Design approval
Customers are responsible for carefully reviewing all proofs, renderings, mockups, written specifications, and order summaries.
Approval confirms the accuracy of:
- Names and spelling;
- Dates and numbers;
- Colors;
- Dimensions;
- Quantities;
- Orientation;
- Layout;
- Text placement;
- Product features; and
- Other specifications presented for approval.
LayerLux Studio is not responsible for an error appearing in the finished product if the same error appeared in a proof or specification approved by the customer.
Digital renderings and screen previews are representations only. Actual colors, surface finishes, proportions, and material appearance may vary.
7. Characteristics of 3D-printed products
LayerLux Studio products are individually made using additive-manufacturing and finishing processes.
The following are normal characteristics of 3D-printed products and are not necessarily defects:
- Visible layer lines;
- Small seams or support marks;
- Minor surface irregularities;
- Slight dimensional variations;
- Minor differences between identical products;
- Differences in filament texture or sheen;
- Small color differences between filament batches; and
- Differences between colors displayed on a screen and the finished product.
LayerLux Studio will determine whether a reported condition is a manufacturing defect or a normal characteristic of the production process.
8. Materials and substitutions
Material colors and components are subject to availability. If a requested material, color, component, or accessory becomes unavailable, we will contact the customer before making a material substitution that significantly changes the order.
We may make minor internal production adjustments that do not materially change the product's appearance, dimensions, intended function, or value.
9. Customer-provided content
"Customer Content" includes files, photographs, drawings, logos, trademarks, names, text, measurements, models, and other materials submitted by a customer.
You retain any ownership rights you have in your Customer Content. By submitting it, you grant LayerLux Studio a limited, nonexclusive license to access, copy, adapt, modify, and reproduce it solely as reasonably necessary to:
- Evaluate your request;
- Communicate with you;
- Prepare proofs or production files;
- Manufacture the product;
- Provide customer support; and
- Maintain legally required business records.
You represent that:
- You own the Customer Content or have permission to use it;
- LayerLux Studio's fulfillment of your request will not violate another person's copyright, trademark, privacy, publicity, or other rights;
- The content is accurate and lawful; and
- The content does not contain malicious software or harmful code.
We may request evidence of ownership or authorization and may decline a request if we reasonably believe it could violate another party's rights.
You agree to be responsible for third-party claims arising from Customer Content you submitted or instructed us to reproduce, except to the extent the claim resulted from LayerLux Studio's independent actions.
10. LayerLux Studio intellectual property
The LayerLux Studio name, logo, original designs, photographs, graphics, written content, website layout, and other original materials belong to LayerLux Studio LLC unless otherwise identified.
Some products, design files, fonts, components, or creative materials may belong to third-party designers and may be used by LayerLux Studio under a commercial license.
No ownership rights are transferred to the customer unless expressly stated in writing.
Purchasing a physical product does not grant permission to:
- Copy or reproduce the product's design;
- Scan or reverse-engineer the product;
- Manufacture copies;
- Distribute related digital files;
- Resell digital designs; or
- Use our photographs or website content commercially.
These restrictions do not prevent the lawful resale of a physical product you purchased.
11. Product photographs and customer submissions
We will not publicly display a customer's private photographs, personal information, or confidential custom design solely because it was submitted with an order.
If you voluntarily send us a product review, testimonial, or photograph for promotional use, we may ask for permission before using it in marketing.
Any permission may be subject to additional terms communicated when permission is requested. We will not identify a customer by full name without permission.
12. Product use and safety
Products must be used only for their stated purpose and in accordance with all instructions, warnings, and product-listing information.
Unless a listing expressly states otherwise:
- Products are intended for indoor decorative or organizational use;
- Products are not certified as food-safe;
- Products are not intended for direct food preparation or storage;
- Products are not dishwasher-, microwave-, or oven-safe;
- Products should not be exposed to excessive heat or open flames;
- Decorative products are not intended as safety equipment;
- Products are not intended to support a person's weight;
- Products may not be completely watertight;
- Products containing small parts are not suitable for children under three; and
- Decorative products should be kept away from unsupervised children and pets.
Additional safety requirements are provided in our Product Safety and Care Policy, which is incorporated into these Terms.
No disclaimer limits a consumer-product safety obligation imposed by applicable law.
13. Lamps and lighting products
Only LED bulbs of the type and maximum wattage specified in the product listing or instructions may be used with LayerLux Studio lamps.
Customers must not:
- Use incandescent, halogen, heat, or flame-producing bulbs;
- Exceed the stated maximum wattage;
- Place a lamp near an open flame or heat source;
- Cover the lamp or obstruct ventilation;
- Use indoor lighting products outdoors;
- Use a damaged cord, socket, plug, or component; or
- Modify electrical components without a qualified professional.
If a product includes third-party electrical components, those components may also be subject to the manufacturer's instructions and warranty.
Stop using the product immediately if you notice overheating, melting, deformation, an unusual odor, electrical damage, or discoloration near the light source.
14. No open flames
Unless expressly certified and marketed for that purpose, LayerLux Studio candle holders, lanterns, luminaries, and similar products are intended only for battery-operated flameless LED lights.
Do not place a real candle, incense, heating element, or other open flame inside or near a 3D-printed product.
15. Outdoor use
Only products expressly identified as suitable for outdoor use should be placed outdoors.
Sunlight, heat, moisture, freezing temperatures, wind, and weather exposure can cause fading, warping, brittleness, deterioration, or other damage. Outdoor durability depends on the material, environment, product design, and maintenance.
Unless expressly stated otherwise, weather-related deterioration is not a manufacturing defect.
16. Shipping and delivery
Shipping and delivery are governed by our Shipping, Returns, Refunds, and Cancellations Policy.
Shipping and production dates are estimates unless LayerLux Studio expressly guarantees a date in writing.
Customers are responsible for providing a complete and accurate shipping address. Additional shipping costs resulting from an incorrect or incomplete address may be charged to the customer.
17. Returns, refunds, and cancellations
Eligibility for cancellation, return, replacement, or refund is governed by our Shipping, Returns, Refunds, and Cancellations Policy.
Custom-made, personalized, and made-to-order products generally cannot be returned because of a change of mind. This does not affect remedies that may be required for defective, materially incorrect, damaged, or misrepresented products.
18. Third-party services and links
The website may contain links to or integrations with third-party services, including invoicing providers, shipping carriers, social-media platforms, analytics services, and other websites.
LayerLux Studio does not control third-party services and is not responsible for their independent content, availability, security, or privacy practices.
19. Website availability
We try to keep the website and custom-order portal available and accurate, but uninterrupted or error-free access is not guaranteed.
We may change, suspend, or discontinue any website feature when reasonably necessary for maintenance, security, legal compliance, or business operations.
We are not responsible for losses caused solely by temporary website unavailability unless required by law.
20. Prohibited conduct
You may not:
- Use the website for unlawful, fraudulent, or abusive purposes;
- Attempt to access another customer's account;
- Introduce malware or harmful code;
- Interfere with website security or operation;
- Scrape, copy, or reproduce website content without authorization;
- Submit content that infringes another person's rights;
- Misrepresent your identity or authority;
- Use the website to harass or threaten another person; or
- Attempt to order an unlawful, dangerous, or prohibited product.
21. Disclaimer of warranties
LayerLux Studio will provide products and services with reasonable care and in material accordance with the accepted order specifications.
Except for warranties expressly provided in writing and to the fullest extent permitted by applicable law, no additional express warranties are made.
Nothing in these Terms excludes, disclaims, or limits an implied warranty or consumer right that cannot legally be excluded, disclaimed, or limited.
22. Limitation of liability
To the fullest extent permitted by law, LayerLux Studio will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the website, services, or products.
To the fullest extent permitted by law, LayerLux Studio's total liability arising from a particular order or product will not exceed the amount the customer paid for the product or order giving rise to the claim.
These limitations do not apply to:
- Liability that cannot lawfully be excluded or limited;
- Fraud or intentional misconduct;
- Personal injury caused by negligence where such limitation is prohibited; or
- Rights and remedies that applicable consumer law does not permit the customer to waive.
23. Events beyond reasonable control
LayerLux Studio is not responsible for delays caused by circumstances beyond our reasonable control, including carrier interruptions, severe weather, power or internet outages, equipment failure despite reasonable maintenance, material shortages, labor disruptions, government actions, emergencies, or natural disasters.
If such an event materially delays an order, we will communicate with the customer and provide any cancellation or refund rights required by law.
24. Governing law and disputes
These Terms and transactions with LayerLux Studio are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules.
Before filing a lawsuit, the parties agree to make a good-faith effort to resolve the dispute by contacting one another and allowing a reasonable opportunity to respond.
Unless applicable consumer law requires otherwise, a legal proceeding shall be brought in a state or federal court with proper jurisdiction serving Prince William County, Virginia.
Either party may bring an eligible claim in small claims court.
25. Changes to these Terms
We may update these Terms periodically. The effective date at the top of the page will identify the latest revision.
Updates apply prospectively and will not materially alter the terms governing an order that was previously accepted and paid for unless:
- The change is required by law;
- The change benefits the customer; or
- The customer agrees to the change.
26. Severability
If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
27. No waiver
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
28. Entire agreement
These Terms, the accepted quote or invoice, approved specifications, and the policies incorporated into these Terms constitute the agreement between the customer and LayerLux Studio concerning the order.
If there is a conflict, the following order of priority applies:
- A written agreement signed by both parties;
- The final paid invoice and approved specifications;
- The Custom Order Policy;
- These Terms; and
- Other general website policies.
